Asylum Petitions

Who may apply?

According to immigration law, foreign nationals may make application for asylum in the United States if they are in the United States or at a port of entry.

An asylum seeker is a foreign national who is "unable or unwilling to return to his or her country . . . because of persecution, or a well-founded fear of persecution." The term "persecution" has a very specific definition under United States immigration law. Such persecution (or the fear thereof) must be based on the asylum seeker's race, religion, nationality, membership in a particular social group, or political opinion.

Adjustment of Status after a Grant of Asylum

Those whose asylum petitions have been granted are eligible to seek a status adjustment to lawful permanent resident status once they have been in the United States for a year after their asylum petitions are granted.
