Families could be torn apart by Supreme Court decision

Their story is not an unfamiliar or uncommon one. The parents arrived more than a decade ago from Peru on tourist visas. The visas have expired but the parents could stay in the United States if the Deferred Action for Parents of Americans and Legal Permanent Residents (DAPA) is upheld by the United States Supreme Court.

It gives the parents of green-card holders or U.S. citizens permission to stay and work. If the high court decides against President Obama's November 2014, it is possible that the parents will be deported.

In the National Public Radio article we read on the upcoming court decision, the family in question is from Peru, living now in Georgia. But of course, there are families like it in Staten Island, across Pennsylvania and the rest of the nation as well.

“I worry," said the eldest daughter, 21. "I worry all the time." She worries that her parents could be returned to Peru, leaving her and two younger sisters to fend for themselves.

She said that Obama's executive order means safety for her and for her family, as well as potentially millions of others. She hopes it is upheld "so that we just don’t live in fear” and that she and her family can live in the light of day.

If the court agrees with the president, parents who have been in the U.S. since 2010 would be safe from deportation for at least three years, NPR states.

Of course, not everyone would be safe from deportation. Those who have been convicted of a felony, for instance, are often high-priority deportation targets. In those situations, it often makes sense for the person facing deportation to contact an immigration attorney experienced in deportation defense.
