H1-B visa holders not the only people bound by legal restrictions

People who come here on an H1-B visa have to go through numerous steps to qualify for that visa. Once secured, these visas have many restrictions with which you must comply or you could face removal efforts.

However, if you are here on an H1-B visa, you are not the only person who will be bound by the various legal restrictions placed on visa holders if you travel to the U.S. with family. Your spouse and children who can also be admitted into the U.S. will be classified as H-4 nonimmigrants, and they will have to comply with rules and restrictions that could prove to be very difficult.

One of the more limiting restrictions is the one that prohibits spouses of H1-B visa holders from working.

This means that until and unless a spouse secures a green card, he or she cannot have a job or contribute financially to their family. This can put incredible strain on marriages and personal relationships. A recent article in The Guardian examined this dynamic and the impact these restrictions have on families, particularly those in Silicon Valley, which is where many H1-B visa holders work.

This can and does certainly take a toll on immigrant families who would rather not be restricted in this manner. Spouses can have their careers upended and feel angry, bored, resentful and isolated.

If you are in this situation, however, you are not without options. You can take steps to secure your own visa, and there are H-4 dependent spouses who are eligible for employment authorization through the U.S. Citizenship and Immigration Services.

Whether you ultimately comply with the restrictions at hand or decide to pursue a green card or the authorization to work in New York, a legal representative can prove to be a critical ally in helping you understand your rights and options. With the guidance and support of an attorney, you can take the necessary steps toward the future you want in the U.S.
